The Digital Millennium Copyright Act (“DMCA”) serves to safeguard content creators from unauthorized reproduction and distribution of their work online. This policy outlines how TrackFlick addresses copyright infringement notifications and how individuals may submit a copyright infringement complaint.

Protection of Intellectual Property

TrackFlick acknowledges the importance of protecting intellectual property rights. We promptly respond to clear notifications of alleged copyright infringement that adhere to the requirements of the United States Digital Millennium Copyright Act (“DMCA”) of 1998.

Before Filing a Copyright Complaint

If you are uncertain whether the material you intend to report infringes upon your copyright, we recommend seeking legal advice before proceeding with a notification.

Submitting a Copyright Complaint

If you are a copyright owner or an authorized agent and believe that material available on TrackFlick infringes your copyrights, you may submit a written copyright infringement notification (“Notification”) to the following email address: [email protected] or Contact Us

All Notifications must comply with the DMCA requirements and include the following information:

  1. Identification of the copyrighted work claimed to have been infringed.
  2. Identification of the material that is claimed to be infringing or to be the subject of infringing activity and that is to be removed or access to which is to be disabled, and information reasonably sufficient to permit the service provider to locate the material.
  3. Contact information, including your name, address, telephone number, and email address.
  4. A statement that you have a good faith belief that use of the material in the manner complained of is not authorized by the copyright owner, its agent, or the law.
  5. A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.

Review Process

Upon receipt of a valid Notification, TrackFlick will review the complaint for accuracy, validity, and completeness. If the requirements are met, appropriate action, such as the removal or restriction of access to the allegedly infringing material, may be taken.

Notice to Affected Users

If material is removed or access is restricted in response to a Notification, TrackFlick will make reasonable efforts to notify the affected user and provide information regarding the action taken.

Reservation of Rights

TrackFlick reserves the right to refrain from taking action if a DMCA copyright infringement notification fails to comply with all requirements specified by the DMCA.
